Welcome to Giggi.in, owned and operated by Giggi Pvt. Ltd. (“Company”, “we”, “our”, or “us”). By accessing and using our website, mobile app, or any related services (collectively, the “Platform”), you agree to these Terms and Conditions (“Terms”). Please read them carefully before using Giggi.in.

If you do not agree to these Terms, please do not access or use our Platform & please stop using Giggi.in immediately.

• You must be at least 18 years of age and legally competent under the Indian Contract Act, 1872 to use Giggi.in. By using our Platform, you confirm that you are eligible to contract and are not barred from using our services under any applicable law.
• Users who are suspended, banned, or otherwise restricted from using Giggi may not create a new account or access the Platform.
• By using Giggi, you represent that all information provided by you is true, accurate, and up-to-date.

Giggi is a buy & sell used car marketplace that allows:

• Car owners to list and sell their vehicles.
• Buyers to browse and purchase cars through secure and transparent transactions.
• Additional services including RC transfer assistance, car valuation, inspection support, loan assistance, and insurance services.

All services are subject to availability, and Giggi reserves the right to add, modify, suspend, or remove any service at its sole discretion.

• To access certain features, you may need to create an account using your email, phone number, and other details.
• You are responsible for maintaining the confidentiality of your account credentials.
• Notify us immediately at >support@giggi.in if you suspect unauthorized use of your account.
• You agree to be responsible for all activities carried out under your account.

• All car valuations shown on Giggi are indicative and subject to physical inspection.
• Sellers must provide accurate details about the car, including registration, service history, accident details (if any), and ownership documents.
• Giggi reserves the right to verify, edit, or remove any listing that violates our policies or contains misleading information.

• Any payment made for car purchases, deposits, or services will be securely processed through our authorized payment partners.
• Prices listed are non-negotiable unless otherwise specified.
• Users are responsible for applicable taxes, transfer fees, and other government charges related to the transaction.

• Giggi assists with RC transfer and other legal formalities but is not liable for delays caused by RTOs, government processes, or third parties.
• Sellers must ensure that their car is free from pending challans, loans, or disputes before selling.

When using Giggi.in, you agree NOT to:

• Post false, misleading, offensive, or unlawful content
• Violate any applicable laws including motor vehicle, privacy, and cyber laws under the Information Technology Act, 2000
• Attempt to hack, disrupt, or misuse our Platform

Violation of these terms may lead to account suspension or legal action.

• All content, design, trademarks, and logos on Giggi.in are the exclusive property of Giggi Pvt. Ltd.
• You may not copy, reproduce, distribute, or use Giggi’s content without prior written permission.

Giggi provides its Platform and services on an “as-is” basis without warranties of any kind. We are not liable for:

• Loss of data, profits, or reputation.
• Delays, errors, or interruptions in services.
• Any disputes between buyers and sellers beyond the scope of our facilitation services.
• Our maximum liability shall not exceed the fees paid by you (if any) for the service in question.

You agree to indemnify and hold Giggi Pvt. Ltd. , its employees, partners, and affiliates harmless from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms.
• Your misuse of the Platform.
• Your infringement of any third-party rights.

Giggi may suspend or terminate your access to the Platform if you:

• Violate these Terms.
• Provide false information.
• Engage in fraudulent or illegal activities.
• Termination may include deletion of your account and data.

These Terms are governed by the laws of India. Any disputes shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.

• The arbitration shall be conducted by a sole arbitrator appointed mutually.
• The venue of arbitration shall be New Delhi, India, and proceedings shall be in English.
• Courts at New Delhi shall have exclusive jurisdiction for any legal matters.

Giggi reserves the right to update or change these Terms at any time. The updated Terms will be posted on this page with a revised date. Continued use of the Platform after changes means you accept the updated Terms.
